Terms of service
General Terms and Conditions
1. Introduction
1.1 These terms and conditions apply to the use of our website and to the purchase of products offered through our website.
1.2 The terms and interpretations defined in these terms and conditions are set out in section 26.
2. Acceptance
2.1 You represent and warrant that:
(b) you are authorized to enter into a legally binding contract with us; and
(c) you are not prevented by any applicable law or contract from entering into a legally binding contract with us.
2.2 We reserve the right to request written confirmation of your authority to accept these terms.
2.3 You represent and warrant that you have not:
(a) been convicted of a computer or internet offense; and
(b) previously been denied access to products or the website.
2.4 We reserve the right to deny you access to our website if we believe that such a refusal is necessary or appropriate.
2.5 Placing an order means:
(a) your representation and warranty that you have read these terms and conditions carefully and in their entirety;
(b) your offer to complete the purchase of the order solely in accordance with these terms and conditions;
(c) your agreement that any order confirmation will be based solely on these terms and conditions; and
(d) your commitment to us to comply with these terms and conditions.
2.6 If you do not accept these terms and conditions, you must not use the website or purchase any products.
2.7 You must expressly accept these terms and conditions in order to:
(a) submit information to or through our website; or
(b) purchase a product.
2.8 By visiting our website, purchasing products or accepting these terms and conditions:
(a) you also accept our privacy policy; and
(b) you accept and agree to comply with our acceptable use policy (see section 12 below for further details).
2.9 We recommend that you print a copy of these terms and conditions for future reference.
2.10 If you do not accept these terms and conditions, you will not be able to place an order or communicate with us.
3. Personal Use
You acknowledge that you are using the website to purchase products solely for your personal use and not for commercial purposes, as a principal and not as an agent or on behalf of any other person.
4. Prices
4.3 We will do our best to ensure that all details, descriptions and prices of products displayed on our website are correct. However, errors may occur. If we discover that a pricing error has occurred, we will inform you as soon as possible and give you the option to confirm your order at the correct price or to cancel your order. If we are unable to contact you or do not receive a response from you, the order will be deemed canceled and you will receive a full refund. If you decide to confirm your order, we will arrange delivery of your order and charge or refund the amounts stated in the notice we send you shortly after receiving your order confirmation, using the payment method and manner you used to place your order.
4.4 We are not obliged to fulfill an order if the price stated on the website is incorrect (even after you have received an order confirmation).
4.5 Prices may change from time to time. However, such changes will not affect an order for which an order confirmation has been sent.
5. Placing an Order
5.1 After you place an order, all orders are subject to availability in stock. If we have sufficient stock to fulfill your order, you will receive an order confirmation, which is deemed to be our acknowledgment of receipt of your order. In the event of delivery problems or insufficient stock to fulfill your order, we will inform you by email and refund any payments made for the order.
5.2 A contract is formed only once we have issued an order confirmation to you, and only with respect to the product(s) listed in the order confirmation. These terms and conditions form an integral part of the contract and apply to the exclusion of all other terms and conditions.
5.3 If your order contains more than one product, the products may be delivered in separate shipments at different times.
5.4 We reserve the right to remove products from the website at any time. We also reserve the right to change or delete material or content from the website. We are not liable to you or any third party for the removal of a product from our website or for the editing or deletion of material or content from our website.
5.5 We reserve the right to reject or cancel any order placed by you at any time (including after an order confirmation has been sent). We are not liable to you or any third party for the cancellation or rejection of an order.
5.6 If we cancel your order after receiving payment (and also after sending an order confirmation), the payment for the order will be refunded to you in full.
6. Payment
6.1 You can pay for the products using one of the payment processors listed on our website.
6.2 You can also pay for part or all of your order using a promotional voucher provided by us. Promotional vouchers can only be entered online at checkout.
6.3 We may use payment processors to process payments between you and us. You agree that we may transfer documents and information about you to these payment processors, including documents and information containing your personal data.
6.4 We are not a regulated payment processor or provider of financial services and are not responsible for any payment errors or problems caused by payment processors.
6.5 It is your responsibility to provide complete and accurate information during the payment process, and all payments must be made with your own funds. By placing an order, you confirm that:
(a) the payment method used for payment belongs to you;
(b) if applicable, you are the rightful holder of the promotional voucher; and
(c) you have sufficient funds or credit facilities to pay for the relevant order.
6.6 We are not liable for the unauthorized use of your credit, debit or prepaid cards by third parties, even if those cards have been reported stolen. We have the right to notify all relevant authorities (including credit reference agencies) of any fraudulent payments or other unlawful activity.
6.7 You must not:
(a) make or attempt to make chargebacks in connection with any payment you have made for products; or
(b) cancel any payment you have made for products.
6.8 You must indemnify us against any chargeback or cancellation of any payment made by you and any loss, cost, liability or expense that we may suffer as a result of or in connection with any such chargeback or cancellation.
7. Delivery
7.1 We will endeavor to deliver your order to the delivery address provided when you place your order.
7.2 We provide an estimated delivery date during the ordering process.
7.3 We may notify you if we are unable to meet the estimated delivery date, but we are not liable for any loss, liability, cost, damage, charge or expense arising from late delivery, to the extent permitted by law.
7.4 We may not be able to deliver products to certain locations. In that case, we will inform you and take steps to cancel and refund the order or deliver the order to an alternative delivery address that you have confirmed.
7.5 All risk in the product passes to you as soon as the product has been delivered to the delivery address, unless delivery is delayed because of a breach of your obligations under these terms and conditions. In that case, risk passes at the time when delivery would have taken place had you not breached the agreement.
7.6 If you are unable to accept delivery or collection of your order, we may leave a card with instructions for redelivery or for collection from the carrier.
7.7 If delivery or collection is delayed because of your unreasonable refusal to accept delivery, or if you fail to accept delivery or collect the order from the carrier, we may charge you for all reasonably incurred fees and other costs that we incur in returning the order to the sender, without prejudice to our other rights or remedies.
8. Cancellation or Modification of Orders
8.1 Once an order has been placed on our website, you may cancel or modify it by sending us an email.
8.2 Because orders are processed quickly, we cannot always stop an order that has already been prepared for shipping. You can always return your order after delivery under section 10 and our refund policy.
9. Defective Products
9.1 You acknowledge that the products are standard products and are not tailored to your specific requirements.
9.2 All product descriptions, information and materials provided on the website are provided "as is" without any express or implied warranties or other representations.
9.3 Product images may differ slightly from the actual product you receive.
9.4 If the product you receive is defective, you may send us an email telling us which product you need to return and attaching a photo of the defective product.
9.5 You may return the product to us in accordance with section 10.
9.6 We will inspect the product upon receipt. Our processing time depends on your order.
9.7 We will notify you by email if we are satisfied that the product is defective.
9.8 Our sole obligation to you with respect to defective products is either (at our discretion):
(a) to replace the product and pay the cost of delivering the products to the delivery address, in which case you must return the defective product to us and we will deliver a replacement product to you at the delivery address; or
(b) to pay you an amount equal to the price of the product and of returning the defective product to us. We will pay you this amount by transferring it to the account from which we received the payment, using the same payment method.
9.9 If we determine that the product is not defective, we may, at our discretion, decide not to refund the purchase price of the product to you, and we may require you to pay all reasonable service charges and deduct these from the payment method you used to place the order. We are not liable to you for any loss, liability, cost, damage, charge or expense arising under this section, to the extent permitted by law.
10. Returns and Refunds
10.1 Our return policy forms part of these terms and conditions, on the basis of which you may access and use our website.
10.2 If you are not completely satisfied with your order, you may send us an email informing us of the product to be returned and send it back to us. The withdrawal period is 30 days from the day on which you, or a third party designated by you who is not the carrier, collected or took possession of the last product.
10.3 The return shipment and its costs must be borne and paid by the customer.
10.4 We must have received the product in order for the customer to be entitled to a refund. We will inspect the returned product when it arrives.
10.5 You must ensure that the product is returned to us in the same condition in which you received it and that it is properly packaged. The product must be unused, the labels on the product must not have been altered, and the product must be in its original packaging. If a product is returned to us in an unsuitable condition, we reserve the right not to accept the return of the product.
10.6 Our processing time for returns depends on your order.
10.7 If we are satisfied with the condition of the product you return to us, we will send you an email approving your return. A refund will be issued promptly to the payment method used for the order after we have notified you that your return has been approved.
10.8 The cancellation is complete once we have received the physical goods.
11. Vouchers
11.1 You may use our promotional vouchers or discounts when paying for products on the website.
11.2 To redeem a voucher or apply a discount, the voucher or discount code must be entered on the payment page of our order process.
11.3 Once the voucher or discount code has been entered and applied, the voucher or discount will be applied to the total amount of your order at checkout.
11.4 You may only redeem or use one voucher or discount per order.
11.5 The balance on a promotional voucher does not bear interest and has no cash value.
11.6 If the balance on a promotional voucher is not sufficient for your order, you may pay the difference using a separate payment method available on the website.
11.7 If you use a voucher for an order that has been returned, the value of the voucher will not be refunded to you. However, if you paid part of the order with a separate payment method, that part may be refunded.
12. Acceptable Use

13. Links to Our Website
13.1 Links from our website to other websites and resources provided by third parties are provided for information purposes only. Links from our website to other websites and resources should not be regarded as a recommendation or endorsement by us of those linked websites or resources or of the information you obtain from them.
13.2 You acknowledge and agree that we have no rights in or control over the content of other websites or resources linked to or from our website.
13.3 You may link to our website, provided that you do so in a way that is fair and lawful and does not damage or take advantage of our reputation.

13.5 You must not link to our website from a website that you do not own.
13.6 You must not frame our website on any other website or create a link to any part of our website other than the home page.

13.8 The website you link from must comply in all respects with the content standards described in our acceptable use policy (see section 12 above).
13.9 Please contact us to obtain our prior permission for any link to our website that does not comply with this section 13.
14. Intellectual Property Rights
14.1 The code, structure and organization of the website are protected by intellectual property rights.
14.2 We are the owner or licensee of all intellectual property rights in our website and in the content and material published on it. These works are protected by applicable laws and treaties throughout the world. All such rights are reserved.
14.3 You may use the website and its content only for your personal, non-commercial use and in accordance with these terms and conditions. The content on the website includes product-related content.
14.4 You agree to notify us of any suspected infringement of intellectual property rights belonging to us.
14.5 You must not use our trademarks without our prior written permission, unless they form part of material that you use (and reproduce accurately) in accordance with paragraph 13.
15. Data Protection
15.1 Our privacy policy forms part of these terms and conditions, on the basis of which you may access and use our website.
15.2 We use cookies on our website. We also use cookies to track how our customers prefer to visit our website. By accepting these terms and conditions, you also give your consent to our use of cookies for this purpose. For more information about cookies, please see our privacy policy.
15.3 If you provide us with your personal data, we will process that personal data from time to time in accordance with your instructions and take appropriate security measures to protect that personal data against unauthorized and unlawful processing and against accidental loss, destruction or damage.
15.4 Unless special safeguards are appropriate or otherwise agreed in writing, the information and documents created in connection with the sale of the products may be exchanged between us, and in particular such information and documents may be made available in electronic form to any of our employees, officers, consultants or agents.

16.5 You must not attack our website via a denial-of-service attack or a distributed denial-of-service attack.
16.6 If we believe that you have breached the provisions of this section 16, your right to use our website will cease immediately. We may report any breach to the relevant law enforcement authorities and will do so if required under applicable law.
17. Liability
17.1 Subject to paragraph 17.13, to the fullest extent permitted by law, we disclaim all liability and accept no responsibility for any loss suffered by you or any other person as a result of:
(a) third-party content or user content;
(b) our content, in particular the accuracy, completeness or timeliness of our content;
(c) products, in particular quality, illustrations, description or specifications, conformity with the description and the fitness of the products for a particular purpose;
(d) reliance on the information in these terms and conditions or on our website or on the functions provided in these terms and conditions or on our website;
(e) any inability to access the website or any part of it, or access being interrupted or partial or not working correctly at any time; and
(f) any failure or delay in performing any of our obligations, whether or not we notify you, if and to the extent that the failure or delay is caused by circumstances beyond our reasonable control, including telecommunications failure, power failure, terrorist attack, fuel strike, bad weather, computer failure, supplier failure, labor dispute and absence of personnel due to illness or injury, and the time for performance of any obligation whose performance is affected thereby will be extended accordingly.
17.2 We are not liable to you (whether in contract, tort (including negligence), breach of statutory duty or otherwise) for loss of profit, business opportunities, goodwill, savings or benefits, or for any indirect, special or consequential loss or damage of any kind, even if such loss or damage was reasonably foreseeable or the party concerned knew of the possibility that such loss or damage might arise.
17.3 Our liability arising directly or indirectly under these terms (including your purchase of products from us under these terms), or which is not otherwise expressly excluded under these terms, will be limited to the greater of USD 1,000 and five times the price you paid for the products giving rise to the liability. The amount of this limitation of liability will be reduced by the amount of any unpaid sums you owe us.
17.4 Any claim by either party for breach of contract, tort (including negligence), breach of statutory duty or otherwise arising out of or in connection with these terms must be brought within one year of the act or omission that would have caused the loss or expense.
17.5 Unless a claim cannot be excluded or limited by law, no claim under or in connection with these terms and conditions may be brought by you personally against any of our employees, officers, consultants or other agents involved in performing the relevant obligations.
17.6 All representations or warranties, whether contractual or non-contractual, and all warranties, conditions, terms, obligations and duties implied by law, common law, trade usage, course of dealing or otherwise (including implied warranties of satisfactory quality, conformity with description and fitness for purpose) are excluded to the fullest extent permitted by law.
17.7 No claim may be brought against us (including our employees, officers or consultants) other than for one act or omission. An act or omission includes a series of related acts or omissions, the same act or omission in a series of related matters, or similar acts or omissions in a series of related matters, and includes all claims arising from one matter.
17.8 The limitations in this section 17 apply to our total liability to you (including any other third party to whom we are liable, with or without our consent) for any claim, and you and all such other persons together may make only a single claim against us for the same loss.
17.9 Where a limitation of liability applies regardless of amount, the limitation will apply to the whole of our provision of the service or product, and there will be no separate aggregate limitations of liability applying to you, each company in the group to which you belong, and all persons designated by a group user.
17.10 If we are jointly and severally liable to you together with another party, we are only obliged to pay you the share that can reasonably be attributed to our liability. We are not obliged to pay you the share attributable to the liability of another party for which that other party would otherwise be liable.
17.11 Any liability we may have to you will be reduced by the share for which another party would have been liable if either:
(a) you had also brought proceedings against the other party or made a complaint against the other party; or
(b) we would have brought proceedings against the other party under any applicable law, or made a claim against the other party.
17.12 In determining whether other parties are liable to you, no account will be taken of your inability to bring proceedings against another party because the claims against that party are time-barred, that party has insufficient funds, that party invokes exclusions or limitations of liability, or the other party no longer exists.
17.13 The exclusions and limitations of liability in these general terms and conditions do not affect our liability:
(a) in the case of death or personal injury caused by our negligence;
(b) for fraud or gross negligence in connection with professional obligations;
(c) for any other liability that cannot be excluded or limited in the jurisdiction in which a relevant claim is brought, including limitations on our right to limit our liability; and
(d) in all other cases where limiting our liability would result in an amount lower than the minimum amount required in the circumstances under any other law or regulation applicable to the claim, in which case such minimum amount will be deemed to apply in place of the amount that would otherwise apply.
17.14 These terms constitute a comprehensive list of the remedies that either party or a third party may have against either party under or in connection with these terms.
18. Indemnification
18.1 You must fully indemnify the indemnified parties, on request, against all claims, costs and losses of any kind that the indemnified parties suffer or may suffer arising out of or in connection with:
(a) any material breach by you of the provisions of these terms and conditions;
(b) any fraud, negligence, misconduct or gross negligence on your part in connection with your obligations under these terms and conditions; and
(c) your use of our website.
18.2 We are entitled to recover from you all costs reasonably incurred by us in connection with any claim for damages, and all such costs must be paid on demand.
19. Force Majeure
19.1 If an event of force majeure lasts longer than one week, we may terminate these terms and conditions immediately by written notice, with no obligation other than to refund the product that you have already paid for but that has not been delivered.
19.2 We reserve the right to exercise absolute discretion as to the solution for fully performing our obligations under these terms and conditions in the event of a force majeure event.
20. Changes
20.1 We may amend these terms and conditions from time to time. We will notify you in advance of any material change that we believe may be to your detriment. We will notify you of any changes to these terms and conditions. The current terms and conditions apply to your use of our website and to all products offered through our website.
20.2 If you do not accept the revised terms and conditions, you must stop using our website or purchasing our products.
20.3 If you have given your express consent to these terms and conditions, we will ask for your express consent to the revision of these terms and conditions before your first purchase of products after the change has taken effect. If you do not give your express consent and acceptance of the revised terms and conditions within the period specified by us, you must stop using the website or purchasing our products.
21. Your Breach
21.1 Without prejudice to our other rights under these terms, if you breach these terms in any way, or if we have reason to believe that you have breached these terms in any way, we may:
(a) send you one or more formal warnings;
(b) temporarily suspend your access to our website;
(c) temporarily suspend the processing of any order;
(d) reject any payment you have made;
(e) permanently deny you access to our website;
(f) block access to our website from computers using your IP address;
(g) contact all of your internet service providers and ask them to block your access to our website; or
(h) take legal action against you, whether for breach of contract or otherwise.
21.2 If we block, prohibit or impede your access to our website or any part of our website, you must not take any action to circumvent that block, prohibition or impediment.
22. Termination and Suspension
22.1 You may stop using the website at any time.
22.2 We may suspend the provision of the website at any time for any reason and with or without notice.
22.3 Without prejudice to section 22.2, we may suspend or terminate your access to the website if your use of the website may give rise to legal liability of any kind or interfere with the user experience of others.
22.4 If we suspend or terminate your access to the website, we will notify you in advance. However, we may, at our discretion, suspend or terminate your access to the website immediately and without notice.
22.5 We do not warrant that our website will always be available or will be available without interruption. We may interrupt, suspend, remove or restrict the availability of our website or any part of it for business or operational reasons. We will give you reasonable notice of any interruption or removal. In the event of interruption, suspension, removal or modification of the website, you are not entitled to any compensation or other payment.
23. Effect of Termination
23.1 Termination of these terms and conditions will immediately end any service obligation to the customer.
23.2 You will under no circumstances be entitled to compensation from us for loss of rights, loss of business assets or any other loss arising from the termination of these terms and conditions for any reason.
23.3 Termination of these terms and conditions does not affect any rights that have already accrued and does not affect the provisions of these terms and conditions that are to continue in force in accordance with their terms or that come into effect at a later time. Sections 17 (Liability) and 18 (Indemnification) will survive termination of these terms and conditions.
24. General Provisions
24.1 You may not assign any of your rights under these terms and conditions.
24.2 The rights, powers and remedies provided in these terms and conditions are (unless expressly stated otherwise) cumulative and not exclusive of any rights, powers and remedies provided by law or otherwise.
24.3 We outsource the hosting of the website to a third party.
24.4 If the validity or enforceability of any provision of these terms and conditions is in any way limited by applicable law, that provision will remain valid and enforceable to the maximum extent permitted under that law. If any such provision is invalid or unenforceable, this does not affect the validity or enforceability of any other provision.
24.5 Failure or delay in exercising any right, power or remedy under these terms and conditions or under law does not constitute a waiver of that right, power or remedy. If we waive a breach of any provision of these terms and conditions, this will not be deemed a waiver of any subsequent breach of that provision or a waiver of any breach of any other provision.
24.6 The exercise of the parties' rights under these terms and conditions is not subject to the consent of any third party.
24.7 These terms and conditions are for the benefit of you and us and are not intended to benefit, or to be enforced by, any third party.
25. Governing Law
25.1 These terms and conditions, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of the Netherlands. This does not take away any mandatory consumer protection that applies to you under the law of the country where you live.
25.2 Any dispute arising out of or in connection with these terms and conditions will be submitted to the competent court in the Netherlands, unless mandatory consumer law gives you the right to bring it before a court where you live.
